Terms of Service

These Terms of Service (“Terms”) are an agreement between you and BEYOND EARTH Co.,Ltd. (“BEYOND EARTH,” “we,” “us”). They govern your use of our website at www.beyondearth.co.kr and of our Amazon Selling Partner API application, BEYOND EARTH Amazon Analytics (the “App”) — together, the “Services.” By using the Services or authorizing the App, you agree to these Terms. If you use the Services on behalf of a company, you confirm that you have authority to bind that company, and “you” refers to that company.

With the seller’s authorization, the App connects to the seller’s Amazon account through the Selling Partner API to provide sales, order and profit dashboards; inventory and listing monitoring; and settlement and financial reporting. The App may be provided together with our Amazon operations and consulting services. If you have a separate service agreement with us, that agreement governs those services and prevails over these Terms where they conflict.

The Services are intended for businesses. To authorize the App, you must own the Amazon selling account or be authorized by its owner to grant third-party access to it. You agree to provide accurate information and keep it up to date, and you are responsible for the actions of the users you allow to access the Services.

You grant the App access through Amazon’s official consent page. This allows us to retrieve the data described in our Privacy Policy, solely to provide the Services to you. You can revoke this access at any time in Seller Central under Apps and Services → Manage Your Apps. After revocation, features that depend on Amazon data stop working, and we delete stored Amazon data as described in our Privacy Policy.

You agree to:

• Comply with all applicable laws and with Amazon’s agreements and program policies, including the Amazon Services Business Solutions Agreement
• Keep your Seller Central and other credentials secure — we will never ask for your Amazon password
• Notify us promptly of any unauthorized access or security concern
• Review the App’s reports before relying on them for business, tax or financial decisions

You must not:

• Reverse engineer, decompile or attempt to extract the source code of the App, except as permitted by law
• Interfere with or disrupt the Services, or attempt to gain unauthorized access to any system or data
• Use the Services in violation of Amazon’s Acceptable Use Policy or Data Protection Policy, or to process data you are not authorized to share
• Use the Services to infringe the rights of others or for any unlawful, fraudulent or harmful purpose
• Resell, sublicense or provide access to the Services to third parties without our written consent

BEYOND EARTH is an independent company and is not affiliated with, endorsed or sponsored by Amazon.com, Inc. or its affiliates (“Amazon”). Amazon, Seller Central and related marks are trademarks of Amazon.com, Inc. or its affiliates. The availability and accuracy of data in the App depend on Amazon’s services, which Amazon may change, limit or suspend at any time. We are not responsible for Amazon’s services, and your use of Amazon remains subject to your agreements with Amazon.

We handle personal information and Amazon data as described in our Privacy Policy. You retain all rights to your business data. You grant us a limited, non-exclusive license to access, store and process that data solely to provide the Services to you. We do not sell your data, use it for advertising or share it with other sellers.

Fees for the App and our operations services are set out in your quote or service agreement. The initial consultation is free of charge. Unless stated otherwise, fees exclude applicable taxes.

The Services — including the App’s software, design, text and graphics — are owned by BEYOND EARTH or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services for your internal business purposes while you use them. If you send us feedback, we may use it without any obligation to you.

The Services rely on or link to third-party services, including Amazon, GitHub and FormSubmit. Those services are governed by their own terms and policies, and we are not responsible for them.

We work to keep the Services available and accurate, but we may modify, suspend or discontinue features — for example for maintenance, security, legal compliance or changes to Amazon’s APIs. Where a change materially affects you, we will give reasonable advance notice whenever possible.

The Services are provided “as is” and “as available.” Dashboards, estimates (such as profit estimates) and reports are for informational purposes, depend on data provided by Amazon and other sources, and are not financial, tax or legal advice. To the extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement, and we do not guarantee any particular sales or business results.

To the extent permitted by law, BEYOND EARTH is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for our intentional misconduct or gross negligence.

You agree to indemnify and hold BEYOND EARTH harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services or your violation of any law or third-party rights.

You may stop using the Services and revoke the App’s access at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if Amazon requires us to do so. On termination, your right to use the Services ends, and we delete your data as described in our Privacy Policy, except where the law requires us to keep it.

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date at least 7 days before they take effect, or at least 30 days before for changes that are material or adverse to you. If you continue to use the Services after the effective date, you accept the updated Terms.

These Terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute amicably. If a dispute cannot be resolved, it will be submitted to the competent court under the Civil Procedure Act of the Republic of Korea.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent. These Terms, together with our Privacy Policy and any service agreement, form the entire agreement regarding the Services. These Terms are provided in Korean and English; if there is any inconsistency, the Korean version prevails.
